“These general terms and conditions govern the contractual relationship between TPhar Consult SRL (represented by Stéphane Mazilu), registered at the BCE under VAT number BE 0677532627, hereinafter referred to as Tphar Consult SRL, and any person browsing on the site in order to make the purchase of one of the products offered on this site, the consultation of the information or the use of the latter.
ARTICLE 1 – VALIDATION
By placing a reservation on the CONTACT/ORDER form, the Customer acknowledges having read and accepted these General Conditions without reservation. The validation of the reservation therefore implies acceptance of these General Conditions.
ARTICLE 2 – RESERVATION/ORDER
Upon receipt of the reservation, Darwin Lab Europe sends a confirmation message to the customer to confirm acceptance of his reservation or order to the e-mail address provided by him. Confirmation of the reservation or order is only concluded from the moment the confirmation is sent.
Darwin Lab Europe reserves the right to cancel or refuse any reservation from a customer with whom there is a dispute relating to a payment or a previous reservation, or to inappropriate or prohibited use of the reserved products.
In addition, Darwin Lab Europe reserves the right to refuse reservations without having to justify its decision in the event of a problem observed on the operation of the site, including attempts at fraud or circumvention of the security protocols in place.
ARTICLE 3 – AVAILABILITY
In the event of a temporary unavailability of a product after the reservation has been made, Darwin Lab Europe informs the customer of the delivery time by e-mail. If the given deadline does not satisfy the customer, he can then choose to modify or cancel his order.
ARTICLE 4 – PAYMENT
Payment is made by PayPal or bank transfer.
ARTICLE 5 – DELIVERY
After confirmation of the order, the products are shipped via DHL.
ARTICLE 6 – WITHDRAWAL
In accordance with the legislation in force for remote sales or reservations (Book VI, Title 3, Chapter 2 of the Code of Economic Law), the customer has the right to notify TPhar Consult that he is renouncing his reservation without penalty and without giving reasons within a maximum period of 14 calendar days from the day after the day of delivery. This request for withdrawal can be made via a declaration to customer service via the contact page.
The right of withdrawal cannot be exercised either, in accordance with the legislation in force, for the supply of medical devices.
ARTICLE 7 – USE OF PRODUCTS
Before using any product, the customer is required to read the conditions of use appearing on the instructions for use provided to him or contact his physician.
ARTICLE 8 – LIABILITY AND WARRANTY
General
TPhar Consult cannot be held responsible for the total or partial non-execution of a reservation in the event of a shortage of stock or force majeure, defined as the occurrence of an event making it impossible or more difficult on the technical, economic or logistics Darwin Laboratory's performance of any of its obligations to Customer.
